Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is part of, and incorporated into, the Terms of Service between you and PlanFishCatch LLC(“PlanFishCatch,” “we,” “us”). It describes what you may and may not do with the Service. Capitalized terms not defined here have the meaning given in the Terms. Violating this AUP may result in suspension or termination of your account.

1. Safety-critical context

PlanFishCatch is a planning and information tool, not a navigation or safety-of-life system. You must not rely on it as your sole or primary source for navigation, collision avoidance, or any decision on which life or property depends. Always carry and use proper marine navigation equipment and official charts, verify conditions against official National Weather Service marine forecasts and your own instruments, and exercise independent seamanship judgment. The float-plan helper does not file a plan with the U.S. Coast Guard or any authority and is not a substitute for one.

2. Prohibited conduct

You agree not to, and not to permit anyone to:

  • Use the Service for any unlawful purpose, or in violation of any fishing, boating, environmental, or maritime law or regulation, including catch, size, season, and protected-area rules in your jurisdiction;
  • Use the Service to locate, target, or take protected, prohibited, or out-of-season species, or to facilitate poaching or other illegal harvest;
  • Attempt to gain unauthorized access to the Service, other users’ accounts or data, or our systems; probe, scan, or test the vulnerability of the Service; or breach or circumvent any security or authentication measure;
  • Interfere with or disrupt the Service, including by overloading, flooding, or sending excessive automated requests, or by introducing malware or harmful code;
  • Scrape, harvest, crawl, or bulk-extract data or content from the Service, or use any automated means to access it, except as expressly permitted in writing or via a documented API under its own terms;
  • Resell, sublicense, redistribute, or commercially exploit the Service or its data, forecasts, or species intelligence, except as expressly permitted;
  • Reverse engineer, decompile, or attempt to derive source code or underlying models, except to the extent this restriction is prohibited by applicable law;
  • Misrepresent your identity or affiliation, or impersonate any person or entity;
  • Upload or share content that infringes others’ intellectual-property or privacy rights, that is unlawful, or that you do not have the right to share (see our Copyright/DMCA Policy);
  • Submit another person’s personal information (for example, as an emergency contact) without their knowledge and consent;
  • Remove, obscure, or alter any proprietary notices, or any third-party data attributions required by our data providers (see Data & Attributions).

3. Your account and content

You are responsible for activity under your account and for keeping your credentials secure. You must provide accurate information and promptly update it. You are responsible for the accuracy and lawfulness of the data you enter, including waypoints, catch logs, vessel details, and the contacts you choose to notify. You retain your rights in the content you create; you grant us only the limited rights needed to operate and provide the Service as described in the Terms and Privacy Policy.

4. Fair use of shared and community features

Some features draw on aggregated, anonymized community data. You must not attempt to de-anonymize, re-identify, or reverse out any individual user, location, or catch from aggregated outputs, and you must not use the Service to surveil or track another person.

5. Enforcement

We may investigate suspected violations and may suspend or terminate access, remove content, or take other action we consider appropriate, with or without notice, consistent with the Terms and applicable law. We may also report activity to law enforcement where required or appropriate. Nothing here limits other remedies available to us.

6. Reporting

To report a violation of this AUP, abuse, or a security issue, contact support@planfishcatch.com. For copyright complaints, use the process in our Copyright/DMCA Policy.

7. Changes

We may update this AUP as the Service evolves; we will note the effective date above and, for material changes, provide reasonable notice. Continued use after a change means you accept the updated AUP.
