Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PlanFishCatch (the “Service”), operated by PlanFishCatch LLC (“PlanFishCatch,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service — what it is and is not

PlanFishCatch is a trip-planning and information tool for recreational offshore anglers. It aggregates public weather, oceanographic, and bathymetric data into forecasts, condition scores, species likelihood layers, waypoint management, and a float-plan helper.

The Service is not a navigation system, a safety device, or an official source of marine weather. Forecasts, condition scores, and map layers are estimates derived from third-party models and observations that may be delayed, incomplete, or wrong. They are for planning only and must never be used as the basis for navigation or any safety-of-life decision. You are solely responsible for your own go/no-go decisions, for carrying required safety equipment, and for consulting official sources — including NWS marine forecasts, official NOAA charts, U.S. Coast Guard notices, and your vessel’s onboard instruments — before and during any trip.

2. Float plans are not filed with any agency

The float-plan feature lets you record trip details and notify contacts you choose. A PlanFishCatch float plan is not submitted to, monitored by, or on file with the U.S. Coast Guard or any other authority. It helps only if a trusted person ashore has it and knows to call for help if you become overdue. Automated overdue notifications are provided on a best-effort basis and may fail or be delayed; do not rely on them as your sole safety net. In an emergency, contact the U.S. Coast Guard directly (VHF Channel 16 or call 911). You are responsible for the accuracy of the information you enter and for having consent to share the details of anyone you list.

3. Eligibility & accounts

You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for safeguarding your login credentials and for all activity under your account. Provide accurate information and keep it current.

4. Subscriptions, billing & refunds

Core features (dashboard, forecast, float plan, logbook, GPX import, and manual waypoints up to the free limit) are available at no charge. The Angler subscription unlocks additional features and is billed through our payment processor (Stripe) on a recurring basis at the price shown at checkout. Subscriptions renew automatically at the end of each term until cancelled. You may cancel at any time, effective at the end of the current billing period; cancellation during any free trial avoids a charge. Except where required by law, payments are non-refundable. We may change prices on prospective renewals with notice. Where applicable law gives you cancellation or refund rights that cannot be waived, nothing in these Terms limits those rights.

5. Your content & data

You retain ownership of the data you create — waypoints, catch logs, float plans, and trip details. You grant us a limited license to host and process that data to operate the Service. Our handling of personal data is described in our Privacy Policy. We learn from community catch data only in anonymized, above-threshold aggregate, and we never sell your data or expose your individual spots.

6. Acceptable use

You agree not to: scrape, resell, or redistribute the Service or its underlying data feeds in violation of the upstream providers’ terms (see our Data & Attributions page); reverse-engineer or disrupt the Service; misrepresent your identity; upload unlawful content; or use the Service to endanger others. Some data we display is provided by third parties under licenses that restrict redistribution; you may use it only within the Service. Our full Acceptable Use Policy is incorporated into these Terms, and copyright complaints are handled under our Copyright/DMCA Policy.

7. Third-party data & attributions

The Service incorporates data and map imagery from government agencies and third parties (NOAA, NASA, ECMWF, the Meteorological Service of Canada, BOEM, USGS, GEBCO, state marine-resource agencies, OpenStreetMap/CARTO, and others), each under its own license and attribution terms. Those attributions are listed on our Data & Attributions page and surfaced in the map interface. We make no warranty regarding third-party data and are not responsible for its accuracy or availability.

8. Disclaimer of warranties

THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that forecasts, conditions, or scores are accurate or that the Service will be uninterrupted or error-free.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PlanFishCatch LLC AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, OR FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE OR ANY DATA, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. Our total liability for any claim will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless PlanFishCatch LLC from claims arising out of your use of the Service, your content, or your violation of these Terms or any law.

11. Changes & termination

We may modify the Service or these Terms; material changes will be communicated, and continued use after changes take effect constitutes acceptance. We may suspend or terminate your access for violation of these Terms. You may stop using the Service and delete your account at any time.

12. Governing law & disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that the exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
